FURTHER to the man who was given a ticket for smoking in his van ? his 'place of work' (Mail). He should appeal on quite different grounds.

In my childhood, I used to travel on many long train journeys. I would frequently see men being served alcohol outside licensing hours. The reason was that in a moving train, you were not in a 'place', and provided you stopped drinking when the train was stationary, you were not breaking any law.
